WAIVER, RELEASE, and ASSUMPTION OF RISK AGREEMENT
I hereby assume all of the risks of participating in, and watching, any and all activities associated with this Event, and I hereby release and discharge the Released Parties listed below from, and waive any claims relating to, any and all liability for my death, disability, personal injury, property damage, property theft, or other harm of any kind which may occur to me or my property in connection with this Event. I acknowledge and agree that I am releasing the Released Parties from, among other things, liability to me that may arise from the negligence or carelessness of the Released Parties, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. Further, this release and waiver applies to risks and dangers attributable to the Released Parties’ negligence that may not be inherent in the activities relating to this Event. The Released Parties include the following: (a) World Series of Wrestling and its directors, officers, employees, volunteers, representatives, and agents; (b) the sponsors of this Event and their directors, officers, employees, volunteers, representatives, and agents; and (c) participants, officials, spectators, and other people present at the Event. I realize that serious injury is common in martial arts competitions such as the one I am entering and that I could die as a result of injuries I might sustain at the Event. I also realize that if I am injured, I might be disfigured, disabled and/or rendered unable to work again. By entering into this Event I assume the risk for any and all injuries that I may incur in connection with the Event, regardless of whether such risks are inherent in the activities that are expected to occur at the Event, and I expressly give up and waive any and all claims that I or anyone acting on my behalf or through me might have against the Released Parties for any injury regardless of its nature or effect on me as a result of my participation and/or presence at the Event. I hereby consent to receive first aid and any other medical treatment that may be deemed advisable in the event that I appear to require such treatment during the Event.
I hereby waive any claim that I might have against anyone who attempts in good faith to render first aid or other medical assistance that I appear to need during the Event. I further understand that tickets will be sold to spectators to watch the Event; that news media and others might cover the Event; and that still images and video and audio recordings of the Event may be created and presented to to audiences anywhere in the world.
I hereby irrevocably grant World Series of Wrestling, and its successors and assigns, the absolute right and permission to copyright, use, re-use, publish, and republish, from time to time, photographic images and video/audio recordings made at the Event that include my image or likeness (regardless of whether such images or recordings are changed, altered, or distorted in any way or added to other images to form a composite image), or reproductions thereof in color or otherwise made through any media, for art, advertising, trade, or any other purpose whatsoever.
I acknowledge and agree that I shall not receive any compensation in exchange for the rights granted in the previous sentence, and I hereby waive any right to receive such compensation. I represent that I am physically fit, have sufficiently prepared or trained for participation in the Event, and have not been advised to not participate by a qualified medical professional.
I represent that there are no health-related reasons or problems which preclude my participation in this Event.
I represent that I am not presently under the influence of any drug or medication that impairs me, nor will I participate in the Event while under the influence of any such drug or medication.
I further represent (a) that no one affiliated with this Event has encouraged me to enter or made any representations regarding my fitness or ability to participate; (b) that I have read and understood every provision of this waiver, release and assumption of risk agreement; and (c) that I am legally competent to enter into this waiver, release and assumption of risk agreement and that I am freely entering into it without coercion. This waiver, release, and assumption of risk agreement is intended to be as broad and inclusive as is permitted by applicable law, and if any portion is held invalid, I agree that the remaining terms shall continue to be valid and enforceable to the maximum extent permitted by applicable law. I agree that this waiver, release, and assumption of risk agreement may be signed either by a hand-written signature on a paper copy or electronic signature on an electronic copy. If signed electronically, my electronic signature will have the same legal effect and enforceability as a hand-written signature. I acknowledge that by signing this document, I am waiving rights that I may otherwise have in the future to bring legal actions for personal injury or property damage. In case of minors under 18 years old. If the competitor is a minor, I hereby represent that I am a parent and/or legal guardian of the above named minor, who has been given my express permission to compete in the Event. I have read and understood every provision of this waiver, release, and assumption of risk agreement, I am legally competent to enter into this waiver, release and assumption of risk agreement on behalf of the minor (competitor) named herein and any and all successors, assigns or any other representative acting upon the minor's behalf, I am freely entering into this agreement on behalf of such minor without coercion, and I intend to bind both the minor and me to all of the terms of this waiver, release, and assumption of risk agreement.
OTHER TERMS OF PARTICIPATION
The Organizer hereby expressly reserves the right, in its sole and absolute discretion, with or without cause to deny a potential athlete/competitor's registration/application for permission to compete in the event. The terms athlete and/or competitor may be used interchangeably. If any dispute arises out of, or is any way related to your participation in this event, by entering your registration application, you are hereby expressly waiving and giving up your right to a jury trial with respect to any action claim arising from such dispute. The word "dispute" as used above refers to anything, including but not limited to claims for injury (which you have already waived), that may occur or you may claim did not occur at the Event. The information you have provided to World Series of Wrestling is confidential and won’t be sold to any third party. We reserve the right to communicate with you about events and services provided by World Series of Wrestling. You can always opt out from receiving such communications.
